Acceptable Use Policy
This Acceptable Use Policy (“AUP”) defines mandatory behavioral standards, telephony ethics, and regulatory requirements for deploying autonomous AI voice employees through Sancharya (operated by Marketingko, Warangal, Telangana, India).
Outbound commercial voice campaigns are legally permitted strictly between 10:00 AM and 7:00 PM Indian Standard Time (IST). Automated calls initiated outside this statutory window are prohibited and automatically blocked.
Violating anti-spam laws, impersonation, or DNC rules results in immediate account termination. Any remaining Lifetime Credits wallet balance is strictly non-refundable and forfeited.
1. What This Policy Covers
This policy governs all access to and use of Sancharya's autonomous AI voice employees, Swara voice engine, SIP trunking infrastructure, WebRTC telemetry, phone number allocations, and automated campaign engines. Every organization, workspace administrator, developer, and agent operator is bound by this policy as a condition of utilizing our services.
2. Permitted Use Cases
Sancharya is purposefully engineered for legitimate enterprise workflow automation. The platform may be used exclusively for lawful business operations where contacts have provided appropriate consent:
Answering incoming customer inquiries, providing factual organizational knowledge, directing callers to appropriate departments, and capturing messages.
Contacting inbound web prospects who have explicitly requested a demo, quote, or callback through an opt-in form complying with DPDP notice requirements.
Automating calendar bookings, rescheduling consultations, dispatch confirmations, and clinic or office visitation reminders.
Post-sales order status queries, delivery tracking updates, transactional service notifications, and customer satisfaction survey feedback.
3. Prohibited Activities (Strict Zero-Tolerance)
You agree never to engage in, facilitate, or attempt any of the following prohibited telephony or AI practices. Any violation will result in immediate termination:
4. Indian Telephony Compliance & TRAI Regulations
Telecommunications in India are strictly regulated by the Department of Telecommunications (DoT) and the Telecom Regulatory Authority of India (TRAI). Users must adhere to the following standards:
Under the Telecom Commercial Communications Customer Preference Regulations (TCCCPR), 2018, commercial entities must be registered as Principal Entities (PE) on telecom operator DLT portals. Voice headers, sender IDs, and voice consent templates must match verified business registrations.
If you enable call recording on Sancharya, you are legally obligated to program your AI voice employee to deliver a clear disclosure at the beginning of the call (e.g., “This call is handled by an AI assistant and recorded for quality and training purposes”). Failing to notify callers violates wiretapping safeguards and the DPDP Act 2023.
5. Content Restrictions & Voice Synthesis Ethics
When authoring knowledge base documentation, system prompts, or conversational scripts for Swara AI voice agents, you must not inject or instruct the agent to utter:
- Hate speech, communal inciteful remarks, or content that disrupts public order or national sovereignty.
- Defamatory, obscene, profane, or sexually explicit content.
- Unlicensed medical prescriptions, diagnosis, or speculative investment advice presented as professional counsel.
- Unauthorized voice clones of known celebrities, politicians, or living private persons without verified written biometric authorization.
6. Concurrency Limits, Rate Limits & Fair Use
To maintain carrier quality-of-service, prevent network congestion, and protect shared SIP trunks, Sancharya imposes concurrency thresholds based on your account tier.
- High Failure Rate: Campaigns where more than 35% of outbound calls fail due to invalid, disconnected, or non-existent numbers will be automatically throttled.
- Burst Rate Limits: Maximum concurrent simultaneous calls are bounded by your plan's allocated SIP channels. Any attempts to bypass limits via multi-account scripting will trigger an immediate security freeze.
7. Enforcement, Suspension & Forfeiture
Marketingko takes platform abuse seriously to safeguard telecom carriers and consumer trust. Upon detecting or receiving a credible complaint of an AUP violation, we reserve the right to:
- Immediate Temporary Suspension: Halt active outbound dialing queues and disable voice agent routing pending an internal investigation.
- Permanent Account Termination: In cases of willful fraud, spam, DLT bypassing, or harassment, the account will be permanently terminated without notice.
- Strict Credit Forfeiture: In the event of termination for AUP or telecommunications violations, all remaining Lifetime Credits, minutes, and number allocations are completely non-refundable and forfeited to offset carrier penalties and administrative damages.
- Legal & Regulatory Referral: We cooperate fully with law enforcement, TRAI, cybercrime police units, and telecom carriers, and will disclose account logs and call records when compelled by valid lawful process.
Reporting Abuse or Spam Calls
If you received an unsolicited, abusive, or non-compliant voice call originating from a Sancharya-provisioned telephone number, please report it immediately with the dialed number, time, and caller ID to:
